Customer Terms of Service

By registering for the Klamath Farmer’s Online Marketplace, LLC (“KFOM”) website (www.KFOM.org (the “website”)), you, the “Customer”, agree to the following terms and conditions. Please read carefully.
Customer orders are due Tuesday, 11:59PM. After an order is made, the Customer receives an order confirmation. Orders made after the order cycle ends will be on the next order cycle (e.g. an order made Wednesday morning will NOT be ready for pickup the next day, but rather the following Thursday)
Customers may continue to edit their order (add or delete products) until the order cycle ends at 11:59PM on Tuesday.
Please contact firstname.lastname@example.org at least 72 hours prior to pick up for special orders or requests.
"Pickup" is Thursday, 4-6 PM unless otherwise notified by KFOM. The pickup site is located at the west (side) entrance of the Herald & News building located at 2701 Foothills Blvd, Klamath Falls, OR 97601. From the main entrance, follow signs to disabled parking.
The Customer is responsible to stay up to date on changes to pick up procedures through the website and email communications from KFOM.
If the Customer is unable to pick up their order, please contact 541-886-0003 before pickup closes (Thursday) to arrange an alternative pickup time. A $5 service fee will be charged to the customer account when alternative pickup times are arranged. Orders not claimed within one (1) week following the pickup date will be donated.
If an order is not picked up, and alternative arrangements are not made, at the time of KFOM pickup close, orders will be donated and will not be refunded.
KFOM currently accepts the following forms of payment:
Credit Card: Chosen as payment method at checkout and charged after the order cycle ends (Wednesday).
EBT/SNAP: Paid at time of pickup. If there is a remaining balance after SNAP benefits have been used, the Customer is responsible to pay the remainder with other accepted forms of payment.
All customers will be charged an additional $1.95 handling fee at checkout. This covers the cost of packing individual orders and providing the curbside pick up service.
Failure to pay will result in the suspension of your KFOM account until paid in full.
Returned checks will result in an additional $25 service fee.
The Customer shall indemnify, hold harmless and defend KFOM and its members, affiliates, employees, agents, successors and assigns, from and against, and reimburse KFOM with respect to any claim, losses, damages, liabilities, costs and expenses, including interest and attorney's fees incurred by KFOM by reasons arising out of or in connection with any misuse or mishandling of the product.

Klamath Farmer’s Online Marketplace, LLC reserves the right to refuse service to anyone, including to revoke Customer membership should the Customer fail to adhere by the terms and conditions herein. KFOM also reserves the right to alter this Terms of Service agreement without warning, at any time.
